The IRS starts accepting returns in mid January.

Some preparers give their ripoff loans before that, but they can't file your return until mid-January AND if you have W-2 income they're legally required to see your W-2 before filing.

You will be able to start with your 2010 federal income tax return after the IRS gets the 2010 tax returns available toward the end of the year and not before that.
Probably some time after thanks giving and may be even to the middle of December before you will be to apply for and get the high priced loans that you will have to qualify for this year because of some changes that have been made in the processing of the loans.
And that will not be an exactly correctly completed income tax that you will be able to file to the IRS and that the IRS will be accepting until some time in the middle of January 2011 when the IRS makes the final decision about this matter.
Hope that you find the above enclosed information useful good luck to you.

Dear d: If you are looking for money - Dec 6 or sooner is the date for the "Emerald Advance". This is an advance on your next years refund. You will need a recent pay stub and a photo ID to apply. Look in your area for an H&R Block office that offers this product. $30 to set it up.

This advice was prepared based on our understanding of the tax law in effect at the time it was written as it applies to the facts that you provided. Click on my profile to read more. Errol Quinn Enrolled Agent

You can't actually file a tax return until mid-January. IRS has not released an exact date yet. Getting one of those ripoff HRB loans is NOT "filing a tax return."

you will have to check H/R about the loans
but filing is not possible until at least Jan. 16, 2011
in fact, IRS is actually closed for the first 10 days of the year to 'clean' up

May not be available this year. The IRS will no longer give out debt indicators, so H&R won't know if taxes will be withheld for back child support etc.

It's called a refund, not a return - your tax RETURN is the form or set of forms you file with the IRS.

I'm not sure you understand just what a refund is. Through the year you might have money withheld from your paycheck for federal income tax. At the end of the year, you prepare a form called a tax return to calculate how much tax you owe total for the year, and compare that to what was withheld. If you had more withheld than your total tax, you get the extra back as a refund. If you didn't have enough withheld, you have to pay the rest rather than getting a refund.

A refund isn't some sort of bonus the government gives you for working. It's like if you went to WalMart and bought $16 worth of items, but gave the cashier a $20 bill. You'd get a "refund" of $4, but it's not them giving you something, it's just getting your own money back.

And musicman is wrong - you are NOT eligible for EIC.

I don't know if NY has a state return or not, but on your federal return, your taxable income is $31,250, therefore your tax is $4300 that you owe the IRS!
But from that you subtract the withholding during the year, and if you are over 25 , you also subtract $428 for Earned income credit, and the remainder is what you owe, unless your withholding and EIC is more that $4300! Then you get a refund!
